Who is responsible for processing your personal data?

DR. J.R. BOJ QUESADA (hereinafter, the CONTROLLER) informs the USER that it has created profiles on the social networks Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo, and Google+ (specify the platforms where a presence exists), and that it is responsible for the processing of the USER’s personal data carried out through these social networks.

The CONTROLLER informs the USER that this data will be processed in accordance with Regulation (EU) 2016/679 of April 27 (GDPR) and Organic Law 3/2018 of December 5 (LOPDGDD), and provides the following information:

What do we process your personal data for?

Purpose of processing: To maintain a relationship between the USER and the CONTROLLER, which may include:

• Handling requests and queries addressed to the controller
• Providing information about activities and events organized by the controller
• Providing information about products or services offered by the controller
• Interacting through official social media profiles

Why are we allowed to process your personal data?

Legal basis for processing: Article 6.1(a) of the GDPR – the data subject has given consent for their personal data to be processed for one or more specific purposes.

The USER has a profile on the same social network and has chosen to follow the CONTROLLER’s official profile. By doing so, the USER consents to the processing of their personal data made public on their profile.

The CONTROLLER only has access to and processes the USER’s public profile information—primarily the contact’s name. This data is only used within the social network and is incorporated into the CONTROLLER’s system only when necessary to process the USER’s request.

How long will we retain your personal data?

Data retention criteria: The data will be retained as long as the USER does not revoke the consent given.

To whom do we disclose your personal data?

Data disclosure: Information provided by the USER through the CONTROLLER’s social networks, including personal data, may be published depending on the features of the service used. It may become publicly accessible to other users of the social network.

No personal data will be disclosed to third parties outside the social network, unless necessary for the stated purposes or legally required. In such cases, data may be shared with service providers under confidentiality and data processing agreements.

What are your rights?

User rights (limited to information under the CONTROLLER’s control):

• Right to withdraw consent at any time
• Right of access, rectification, data portability, and erasure of your data
• Right to restriction or objection to processing
• Right to file a complaint with the supervisory authority (www.aepd.es)

2. USE OF PROFILES

The CONTROLLER may:

• Access public profile information
• Publish updates on the USER’s profile
• Send direct messages
• Post content updates that appear on the USER’s feed

Users may publish content (comments, images, etc.) if they hold intellectual property rights. Content violating morality, public order, or third-party rights will be removed. The CONTROLLER is not responsible for user-generated content.

3. PUBLICATIONS

Once the USER follows or joins the CONTROLLER’s social media profile, they may publish comments, links, images, photographs, or other multimedia content. The USER must be the owner of the content or have the corresponding rights/consent.

The publication of content that offends morality, infringes intellectual or industrial property rights, image rights, or any law is prohibited. The CONTROLLER reserves the right to remove such content immediately and request blocking of the USER.

The USER should be aware that their publications will be visible to other users, and therefore they are responsible for their own privacy.

Images published on the social network will not be stored in any file by the CONTROLLER but will remain on the social network.

4. MINORS AND SPECIAL NEEDS

Access to and registration through the CONTROLLER’s social media profiles is prohibited for individuals under 14 years old. If the USER has special needs, parental authority, legal guardian, or representative is required, with valid documentation.

The CONTROLLER is exempt from liability for use of social networks by minors or persons with special needs. The CONTROLLER’s social networks do not knowingly collect personal information from minors.
